Emp 205: Liability and Incident Reports and Customer Property Damage

🚧 Prevention First
We have signs in our yard that state American Stone is not responsible for damage to customer vehicles.
Make sure these signs are visible in the yard.
Before loading:
- Review the signs with customers and give them a verbal warning.
- If the customer has a vehicle likely to get damaged (e.g., brand-new truck, delicate trailer), warn them clearly that loading is at their own risk.
- Suggest delivery as a safer alternative when appropriate.
- If the customer insists, then please get them to sign a waiver. A manager can go to the Sign App and issue this to the customer. Alternatively, you can print and have the customer sign here (always attach to their customer card). If you do instead the electronic Sign App form, it will be automatically attached to the customer's card.
Precaution Tips:
- If the loader bucket is longer than the bed, use a spotter or protective padding (e.g., carpet) over the sides.
- Explain that boulders in SUVs can roll and break windows.
- Remind customers that gravel can chip paint or dent beds.
- Ensure customers are aware and accept the risk before loading.
⚠️ Examples of Common Accidents
Despite our best efforts, mishaps sometimes happen:
- Gravel or rocks scratching or denting the vehicle bed or side panels.
- Loader bucket accidentally scraping or overflowing a vehicle.
- Forklift striking a tailgate.
- Pallets breaking a trailer.
- Product dumped in the wrong location.
- Heavy boulders cracking a driveway.
💬 What to Do If a Customer’s Property is Damaged
- Acknowledge the issue — Listen respectfully and identify the concern.
- Apologize that their experience was less than perfect.
- Ask the customer how they’d like the situation addressed — many are satisfied with a simple fix.
- Propose a solution to your manager and seek their approval.
- Leave compensation decisions (e.g., free delivery, discount, replacement item) to the manager.

Tip: Our goal is to keep customers happy without overcompensating unnecessarily — often, clear communication and genuine care go further than costly gestures.

⚠️ Ejemplos de Accidentes Comunes
A veces, a pesar de todo cuidado, ocurren accidentes:
- Grava o piedras rayan o abollan la caja o laterales del vehículo.
- La pala del cargador golpea o se desborda sobre el vehículo.
- El montacargas golpea la compuerta trasera.
- Palets rompen el remolque.
- El producto se deja en el lugar equivocado.
- Rocas grandes rompen la entrada de un camino.
💬 Qué Hacer si se Daña Propiedad del Cliente
- Reconocer el problema — Escucha y entiende la preocupación.
- Pedir disculpas por la mala experiencia.
- Preguntar qué le gustaría al cliente para resolverlo.
- Proponer la solución al gerente y pedir su aprobación.
- Dejar que el gerente decida sobre compensaciones (entrega gratis, descuento, reemplazo).

Nota: El objetivo es mantener al cliente contento sin compensar de más — la comunicación clara y sincera suele ser suficiente.
